DISTANCE SALES AGREEMENT

1. Parties

(hereinafter referred to as “Seller”.)

Buyer:
www.ertenshirts.com the real or legal person who creates an order via the site.
(hereinafter referred to as “Buyer”.)

2. Subject of the Agreement

The subject of this agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of the product/products whose characteristics and sales price are specified below, which the Buyer has ordered electronically via the Seller's website.

3. Product Information and Payment

The type, model, color, quantity, sales price, and payment method of the products are included in the order summary approved by the Buyer during the order.

The Buyer accepts that by confirming the order, they enter under a payment obligation.

4. Delivery and Performance Process

Orders placed via the website, following the order confirmation, are delivered to the contracted cargo company within at most 3 (three) business days.
Public holidays and weekends are not counted as business days.
The delivery time after delivery to the cargo company may vary depending on the Buyer's location.
The Seller is responsible for the delivery of the product in a sound, complete manner and in accordance with the order.

In case of extraordinary circumstances (force majeure – compelling reasons), there may be a delay in the delivery time. In this case, the Buyer is informed.

5. Right of Withdrawal

The Buyer, from the date of receipt of the product, within 14 (fourteen) days without giving any reason and without paying any penal clause, has the right of withdrawal.

For the right of withdrawal to be exercised:

The product must be unused,
The label must not have been removed,
The original packaging and accessories must be complete,
It must not have lost its resalable quality.

The return shipping cost within the scope of the right of withdrawal belongs to the Seller, provided that the Seller's contracted cargo company is used.

6. Cases Where the Right of Withdrawal Cannot Be Used

The right of withdrawal cannot be used for the following products:

Products prepared in accordance with personal measurements or special requests,
Products whose return is not suitable for hygiene reasons (opened underwear, etc.),
Products that cannot be returned due to their nature.

7. Return and Refund Process

The returned product, after reaching the Seller, within 7 business days is examined.

When the return is approved:

The payment is refunded using the same method the Buyer used for payment.
In credit card refunds, it is reflected on the statement within 7–14 business days depending on the bank.

The Seller is not responsible for the processing time of the banks.

8. Order Cancellation

The Buyer can cancel their order before the product status changes to “Shipped”.
For orders delivered to cargo, the right of withdrawal procedure is applied instead of cancellation.

9. Resolution of Disputes

In disputes that may arise from this agreement, Consumer Arbitration Committees and Consumer Courts in the place of residence of the Buyer or the place of the Seller are authorized within the monetary limits determined by the Ministry of Commerce every year.
